Hurt at Work in Barnwell, SC? Your Workers' Comp Rights, Explained

July 24, 2026

If you were injured on the job in Barnwell, South Carolina's workers' compensation system is designed to cover your medical care and part of your lost wages, whether or not the accident was anyone's fault. The catch is that the system rewards workers who act quickly and punishes those who wait. Here is what you need to know.

It Is a No-Fault System

Workers' comp does not ask whether you or your employer made a mistake. As long as the injury happened in the course of your job, you are generally eligible for benefits. That is the point of the system: a faster, more certain path than a lawsuit. In exchange, benefits are limited to specific categories, mainly authorized medical treatment and a portion of your average weekly wage while you cannot work.

Report the Injury Right Away

This is the step that trips up the most claims. South Carolina law expects you to notify your employer of a work injury within 90 days, and sooner is far better. Tell a supervisor in writing if you can, and keep a copy. A verbal mention in a noisy shop is easy for an employer to later claim never happened. Prompt written notice removes that argument entirely.

Get Medical Care and Follow Through

See a doctor, and keep going to your appointments. In workers' comp, the insurer often has a say in which provider you see, so ask about that early. Two things weaken a claim more than almost anything else: a delay between the injury and the first doctor visit, and skipped follow-up care. Consistent treatment records show the injury is real and ongoing.

When a Claim Gets Denied or Delayed

Denials happen even on legitimate injuries. Common reasons include a dispute over whether the injury is work-related, a missed reporting window, or a claim that the injury was pre-existing. A denial is not the end of the road. You have the right to challenge it, and an attorney can request a hearing before the South Carolina Workers' Compensation Commission on your behalf.

Was Someone Other Than Your Employer Involved?

If a third party contributed to your injury, such as a driver who hit you on the job or a defective piece of equipment, you may have a separate injury claim on top of your comp benefits. That second claim can cover losses comp does not, which is worth exploring before you settle anything.

When to Call a Lawyer

You may not need one for a minor, clearly accepted claim. But reach out if your injury is serious, your claim was denied, you are being pushed to return to work too soon, or a third party may share the blame. Our Barnwell personal injury team can look at your situation at no cost, and you can read more about the workers' compensation process on our practice page.
